Richard Jacobs (details and information submitted by Mrs. Jacobs)
Richard Jacobs was put into a position where he felt he had not other choice but to confess to a murder/robbery he had not committed.
Richard was briefly staying with friends, on his way to his dad's home. Jeremy Martin (the person who committed the murder) and his girlfriend were staying with the victim as well. Jeremy Martin had just gotten out of a boot camp and returned to the home of his father, Robert Martin. Richard did not know these people well.
Jeremy Martin wanted his father, Robert, dead. Upon returning to the home one evening his girlfriend provided him with guns. He held a gun to Richards head, told him to shoot and murder Robert Martin, Jeremy's father. Richard was unable to do so, crying and pleading for his own life and that of the victim Robert Martin. Jeremy Martin shot his father in cold blood right in front of Richard. Jeremy Martin told Richard that if said word, his mother and sister would be killed next. Richard had no reason nor motive to commit such a crime, he did not need money nor did he need the victims car, he was going to stay with his dad.
In 2001 a jury found Richard guilty capital murder. The most damning evidence was a false confession. The jury couldn't come up with a sentencing, that is when the judge stepped in and made the choice. He gave Richard life without parole. There was no physical evidence to support this, no proof, no reliable witness's to even put Richard at the scene much less committing the crime.
Richard had never even been in any type of trouble before all this happened. No speeding tickets, drug charges, assaults, nothing he was a good kid barely one month over 18.

The man who actually killed the victim had priors and had already broken not only the victims nose and his girlfriends ribs, but had also stabbed his step dad. He was let out.
The girl that provided the real killer and robber with the guns, and helped hold Richard and another guy at gun point, is now out .
The actual killer is in prison on the same charges and received the same sentencing as Richard. He, however, was sentenced by a jury.
Richard's jury couldn't agree on sentencing so the judge over rode the jury and gave him life without parole. Life without parole for crimes that he did not commit.
New evidence that Richard Jacobs is innocent.
During the arrest process and in court there were many elements of foul play. Not only on the part of the DA, but the Judge and the defense attorneys as well.
The DA was unprofessional, mocking and called Richard names. The defense attorney put up no defense and instead told the jury he was guilty but asked that they spare his life. The defense attorney would not allow Richard to go on stand and tell the truth. Richard, not knowing and understanding the legal process, did not know that he could go against his attorney and take the stand anyway. The defense attorney was operating with a conflict of interest as he had previously worked for the victims family on other legal matters.
The doctor who had observed Richard told the courts his mentality state was at a 12 year old level , the court still proceeded as the defense attorney never raised the issue of competency.
The coroners report and the actual crime scene photos did not add up to what the coroner said on the stand and his assessment of what had happened. The story that was painted for jury was not accurate and went without objection before the jury.
There was no physical evidence
Richards clothes were tested showing no blood from the victim, but that information and lack of physical evidence was also not allowed in court.
Anything that would show Richards innocence was denied by the judge. Richards finger prints were not found any where at the scene nor on the weapons. The victims items that were stolen, including the car, were found on the actual killer - not Richard.
When they people responsible for the crime were arrested, Richard was not with them, he was at his dads. Jeremy Martin and his girlfriend had run and were pursued by helicopters and police. Donnie Ryals had helped the two dispose of the guns.
Richard had only confessed to the murder to save his family from being killed as well. He feared for their safety with reason. He had already been held at gun point and witnessed the murder take place so he knew the guy was capable of killing.
Were asking for the public's help and even any other legal to help us get this story out and help prove Richards innocence as we have on this page and bring home an innocent man.

Now were gonna talk about what all happened during court.
Now before I start I and so many others have this one question what did the judge have against Richard?
As you will see in this post so many things do not add up!
Now Richard was assigned 2 lawyers Mr Hamilton and Mr Gautier.
Did they fully do their job and duty? No
Did the DA Mr Jones and Mr Miller do their job ? No
Did the judge Mr Harkey do his job and live by the oath he took ? No
Here is why we say this!
During the trial it was brought to attention there was a problem with one of the lawyers who was representing Richard which was Mr Gautier. Mr Gautier had represented Mr Martins mom in some other legal affairs and when the judge was told this in court he didn't care to hear it he still allowed him to proceed . Now Mr Gautier was fired after Richard and his dad had found out about it and the judge still allowed him to proceed. In a capital murder case you have to have two lawyers!
Why did judge Harkey take it upon himself to allow Gautier to represent Richard knowing he had helped the man who put a gun to his clients head trying to make him kill his own father family out?
Why would judge Harkey allow it???
First of many mistakes in this case its conflict of interest and he was fired by Richard!
Next mistake Mr Hamilton why would he go up too the jury and say my client is guilty of murder but spare his life and the judge allow it?
My main question is who was the lawyers working for Richard or the judge?
Why I ask that is because of the actions with the judges and lawyers!
Was Richard given lawyers who did not get to know their client as well?
They saw Richard 3 or 4 times prior to the case was that enough time to know their client?
Why would you want to go against your client who is telling you he is innocent?
In the confession he never said "I pulled the trigger" That is not a confession saying I'm a murderer,that is a confession saying a gun was put too my head I couldn't pull the trigger, Martin did and told me if I say he did it he would kill me too!!
That means Richard was taking the fall for murder and our authorities did not do their job cause if they had the timeline would have shown you who the killer was!
Now the confession was played in court not all parties agreed it was audible in court.
The two lawyers says it wasn't audible these are the same two who says he was guilty right so exactly what did they hear that made them see that the confession was false but didn't push for it to be shown as a false confession? Now the Judge and DA says it is and allows it and only plays a small portion of it in the court room and it states the jury barely could hear it?
That means the tape was no good could have even been tampered with since the tape was done in texas and no interrogation or confession period was done in Mississippi where Richard was being tried at!
Mississippi had no clue on the case and what happened on Richards part of the involvement in the murder so therefore once again another mistake made on an innocent man!
Now why was some confessions from other parties thrown out not listened too?
Was it because they were pointing at martin the real killer and in the public's eye the judge was running out of time and he did not have a case against Richard but made one against him for his self so his ratings would go up?
The jury was painted a picture in court of a murder that was so harsh and it was put on Richard.
The jury was told the shotgun was put in the victims mouth by Richard .
If this was true no remains would have been found in front of the victim on the tv it would be in the back once again a lie another mistake.
The judge allowed this in his court room!
The jury comes back with a guilty verdict says they don't wish for the death penalty nor life without parole.
Which means if the jury thought he was a cold blooded killer who brutally killed the victim like Richard was portrayed to be and had done then why not ask for death penalty or life without parole?
Because there was no case and Richard was not the killer.
After all no finger prints only the shotgun was found because they were told were it was!
Did they search for the handgun if so where?
Other parties were involved that they questioned and let go they could have gotten rid of it . They could have found it if they had did their job!
Now when the jury came back and said their peace why did the judge feel he needed to excuse the fact that nothing showed Richard had done the killing but choose to give him life without parole?
Who was the judge and DA and the Lawyers working for and to prove that day in court?
Richard was not given a fair trial and it was rushed and with so many mistakes it makes me question what did the judge have against Richard? You had no evidence no proof that Richard pulled the trigger you had all the proof that Mr martin shot and killed his father but you make an innocent man go to prison for life at 18 because you felt like it or you wanna too look good to the public or ratings what is it?

when the cops arrested Ryals, Martin and the girlfriend the car and keys and money was on them not Richard so how did Richard again rob him?

Martin had all the belongings of the victim on him but richard robbed him?

I'd like to add one more question why did they give Richard and martin the same charges and conviction but Ryals walked and the girlfriend only got 15 years?
why did the state want the girlfriend to turn on martin and when she didn't they charged her and sentenced her?
Why ask her to turn?
Was it because they knew Martin pulled the trigger and because she said no she wouldn't tell you the truth you convicted an innocent man with them?
An 18 year old had guns pointed at him put to his head and had to watch a man kill his dad and was made to confess to something he didn't do now is locked away for life. Cant say he could have told the truth in court cause we know that's a lie look at all the events that took place in court.
If you couldn't figure out the true killer with the clues he was giving you how could you have helped him not loose his life his moms life and sisters. Instead you did exactly what Martin was trying to get him to do that he couldn't do which was take a innocent mas life.

Show me where the evidence showed Richard was guilty he tried telling you in the confession WHY HE WAS SAYING HE KILLED THE VICTIM. HE WAS NOT TELLING YOU HE PULLED THE TRIGGER.
